Welcome to Caribbean Zest. These Terms of Use govern your access to and use of caribbeanzest.com (the "Site"), operated by Caribbean Zest ("we", "us") in the U.S. Virgin Islands, in partnership with Kline IT Solutions for digital platform operation. By using the Site you accept these terms in full. If you do not accept them, please do not use the Site.
1. Use of the Site
You may use the Site for lawful trip-planning and booking purposes. You agree not to: (a) misuse the Site or its forms; (b) attempt to interfere with security or hosting provided by Kline IT Solutions; (c) scrape, republish or commercially exploit our content; or (d) use the Site in violation of any applicable law, including U.S. export and sanctions restrictions — you represent that you are not located in a U.S.-embargoed country and are not listed on any U.S. restricted-parties list.
2. Island Guides, Listings & Accuracy
Destination guides, ferry schedules, weather notes and recommendations are provided for general trip planning "as is" and may change without notice. Third-attraction names, prices, hours and availability belong to their operators. Always confirm critical details (ferry times, entry requirements, tours) directly with the provider or with us before relying on them. Information on this Site is not legal, immigration or aviation advice; U.S. citizens travel passport-free within the USVI, but entry requirements can change — check official sources for current rules.
3. Tours, Bookings & Payment Terms
Caribbean Zest tour and service bookings are confirmed by written estimate. A deposit of 50% of the estimated contracted program is due 90 days prior to arrival, with the balance due 14 days prior. Where a supplier requires a non-refundable deposit, we will request an equal payment at booking. Cancellations require at least 72 hours' notice; the final guaranteed number of participants is due 72 hours before any function, tour or transfer. A $50.00 charge applies to all returned checks and fraudulent chargebacks. Declined card orders may be followed up by email or phone.
4. Intellectual Property
All original content, design, photography supplied by us, the Caribbean Zest name and the compass mark are owned by Caribbean Zest or its licensors. The Site is provided under license for personal, non-commercial use; no license or right is granted beyond these Terms.
5. Mobile Application — End-User License Agreement
Where Caribbean Zest distributes a mobile application through an app store, the license is concluded between Caribbean Zest and the end-user only. The app store operator has no maintenance, warranty or support obligations for our app; we are solely responsible for it, for any product claims, and for investigation and defense of any third-party intellectual-property claim. App usage remains subject to these Terms and the store's terms of service.
6. Contact Forms & Communications
Form submissions are sent to [email protected] and answered by our staff. You agree not to submit unlawful, infringing or malicious content, and to keep submitted contact information accurate so we can complete bookings.
7. Disclaimer & Limitation of Liability
The Site is provided without warranties of any kind. To the maximum extent permitted by law, Caribbean Zest and Kline IT Solutions are not liable for indirect or consequential damages arising from use of the Site or from third-party services booked through it. Nothing in these Terms excludes liability that cannot lawfully be excluded, and we do not limit our liability beyond what applicable law permits.
8. Third-Party Links
Links to partner businesses, government sites or our master portal at klineitsolutions.com are provided for convenience. We don't control and aren't responsible for third-party sites.
9. Changes & Governing Law
